Ana Rita Duarte de Campos explains the custodial measure and how the sentencing range may extend to 25 years
A 15-year-old boy is suspected of killing his mother at the home where they lived in Oeiras. He reportedly called the police himself and confessed to the crime. Commenting on SIC Notícias’ Edição da Noite programme, Ana Rita Duarte de Campos said that, from a substantive law perspective, the case concerns aggravated homicide and, as such, the applicable sentence may be as high as 25 years.
“This minor will be brought before a judge, who will assess whether there are grounds for imposing a precautionary measure. There must be strong evidence supporting the alleged facts, a possibility that an educational guardianship measure may ultimately be imposed — including placement in a juvenile detention centre — and a risk of absconding or of committing further acts of the same nature.”
Regarding the alleged perpetrator’s four-year-old sister, who is believed to have been in the house at the time of the crime, the Abreu Advogados criminal law specialist explains that it will be necessary to determine who can take responsibility for her care. “It will have to be established whether there is a family member who can take her in or whether a social care solution will need to be put in place.”
