Right to protest and scope of judicial decisions examined on SIC Notícias
Ana Rita Duarte de Campos appeared on SIC Notícias to clarify the legal implications of a decision by the Lisbon Administrative Court concerning the installation of tents in public spaces, in the context of protests over the right to housing.
During her intervention, the lawyer explained that the court’s decision applies to the individual case examined by the court and does not mean that the same interpretation automatically extends to other individuals or similar situations.
As she explained, “there is a specific limitation in an individual and concrete case, which was the case of this applicant”, emphasising the importance of distinguishing the effects of a judicial decision from its potential relevance to future proceedings.
The analysis also addressed the mechanisms for reviewing constitutionality under the Portuguese legal system, particularly the possibility for courts to decline to apply legal provisions when they consider a particular interpretation to be incompatible with the Constitution.
Regarding the legal consequences of the decision, Ana Rita Duarte de Campos highlighted the possibility of intervention by the Constitutional Court, explaining that, in such circumstances, “the Public Prosecutor’s Office is required to lodge an appeal”.
