Manuel de Andrade Neves calls for the creation of a disaster fund to mitigate litigation
Manuel de Andrade Neves, partner responsible for the Public & Environment practice at Abreu Advogados, told Jornal de Negócios of the importance of finding new solutions to reduce the rise in litigation associated with the extreme climate events that have been occurring in Portugal.
The lawyer warns that the administrative courts “will become even more overburdened” with legal actions arising from damage caused by natural disasters.
“The creation of a disaster fund could reduce the risk of litigation in the future, depending on its capacity and the conditions under which it is triggered.” The fund “should include a compensation mechanism for damage resulting from extreme weather events that is swift, efficient and transparent, with clear rules on its scope of application, as well as on the minimum and maximum levels of support.”
