Ricardo Henriques comments on the legal framework of “bossware” in Portugal

Ricardo Henriques, partner at Abreu Advogados, comments in Expresso on the use of technologies that monitor employees’ activity, known as bossware, in an article focused on the legal limits of digital surveillance in the workplace. In his statements, Ricardo Henriques explains that the term bossware generally refers to technological solutions that allow the recording of keyboard and mouse usage, as well as other computer interactions, with the aim of tracking and assessing professional performance. He also notes that these tools gained particular prominence with the widespread adoption of remote and hybrid work models during the pandemic.

According to the lawyer, the Portuguese framework differs from that of several other European Union Member States, where there are no labour rules that expressly prohibit this type of monitoring, with oversight being mainly governed by data protection regulations.
