Portuguese Authority for the Work Conditions (ACT) Implements Online Public Notice System
The Authority for the Work Conditions (ACT) has started to issue notifications by public notice on its website in the context of administrative proceedings due to labor offenses.
This mechanism falls within the scope of the Procedural Regime Applicable to Labor and Social Security Administrative Offenses (Law No. 107/2009, Article 8(3)) and is now being put into practice through the effective use of the website as a means of notification in cases where notification by post is not feasible.
Specifically, the ACT publishes its reports, notifications, and administrative decisions, which are deemed to be served on the date of publication and to take legal effect after a three-day grace period.
Once the notification takes effect, a 15-day period begins during which the defendant may:
i. Voluntarily pay the penalty;
ii. Submit a written response, in Portuguese, accompanied by any evidence and indicating the list of witnesses (up to two per offense; being applicable a single penalty for three or more administrative offenses, up to five witnesses)
