New Leniency Regulation approved by Mozambique’s Competition Regulatory Authority
The Mozambican Competition Regulatory Authority (“ARC”) recently approved the new Regulation on the Leniency Regime, by means of Regulation no. 1/2025, of March 21, published in the Official Gazette. This law aims to strengthen the mechanisms for detecting, investigating and deterring practices that restrict competition.
The possibility of reducing fines for companies that voluntarily collaborate with the ARC is foreseen, subject to the fulfillment of cumulative requirements.
The first company to submit relevant evidence may benefit from a reduction of up to 70% of the fine. Subsequent companies may also benefit from reductions, provided that the evidence submitted is of significant additional value to the ARC’s investigation.
Among the requirements to benefit from this procedure are the immediate cessation of the infringement, the absence or insufficiency of evidence that would ensure the imposition of the fine on the parties involved in the prohibited practice and full cooperation with the ARC.
The request can be submitted in person, in writing or orally (with recording).
This new regime is aligned with international practice and is expected to play a central role in detecting and deterring cartels in Mozambique. Companies operating in the country should review their compliance practices and evaluate risk mitigation strategies.
