Maria João Melícias highlights the Private Enforcement Law as a strategic advantage for companies
The Private Enforcement Law (PEL), in Portugal, is giving companies the ability to combat anti-competitive practices and protect their competitiveness. Maria João Melícias, co-head of the Competition, Regulation and European Union Practice Area at Abreu Advogados, explains in an article published by Jornal de Negócios how companies can take advantage of this opportunity.
“Beyond protecting consumers, the PEL was designed as a strategic tool for companies, which are often victims of anti-competitive practices carried out by competitors, clients or suppliers,” she states.
This framework grants a right to compensation and, overall, promotes redress for injured parties, protects consumers and fosters a competition culture that benefits the national economy. “The PEL therefore strengthens the effectiveness of competition policy […] encouraging a business culture of competition that benefits society as a whole,” she concludes.
