Patrícia Viana coordinates the real estate practice at Abreu Advogados and the immigration law subdivision handling complex real estate transactions.

Among Patrícia Viana’s key areas of expertise are M&A operations related to real estate, sale and leaseback transactions as well as construction matters.

She has advised approximately 500 foreign investors in real estate acquisition operations in the context of real estate investments in Portugal, the programs Golden Visa Portugal and Non-Habitual Resident Portugal.

Since 2014 she has participated in M&A operations related to real estate investments, especially in the retail area – Shopping Centres – and coordinated due diligence teams and was also involved in the negotiation and closing of the operations in which she was involved.

In 2008 she was in secondment at a real estate fund management firm where she assisted on the day to day activities of the managed funds, in the years that followed she participated in the creation and regulation of investment funds in Angola and Portugal.

Between 2006 and 2010 her activity was centred primarily on advising real estate developers in constructions, licensing and sale of residential and tourism development as part of the team responsible for licensing and development of a number of tourism projects.

She has extensive experience in advising on sale & leaseback transactions as well as renting in the context of construction.

Patrícia Viana is regularly consulted by foreign offices regarding the Golden Visa and Non-Habitual Resident in Portugal programs and has contributed to Folha de São Paulo articles on Portuguese tax exemptions for foreign residents.

In 2020 Patrícia Viana was nominated in Legal 500 Real Estate and Construction ranking of Next Generation Partners.

Experience

Advising a multinational group in the automotive sector on the preparation and negotiation of leasing and construction of their site in a technological hub.

Advising approximately 500 foreign investors in real estate investments in Portugal in the context the programs Golden Visa Portugal and Non-Habitual Resident Portugal. This includes due diligence on the assets including urban planning, registration, tourism and condominium issues.

Advising a financial entity on the negotiation and sale of a portfolio of approximately 300 mortgage backed non-performing loans. She was involved in the drafting and negotiation of the sale and purchase agreement, organization of documents for the execution and daft of the deed.

Advising multinational groups on the acquisition of Forum Sintra, Forum Montijo, Sintra Retail Park, Forum Coimbra, Forum Viseu, Alegro Alfragide and Alegro Setúbal throughout 2014 and 2018. Her services included the legal due diligence on the assets and culminated on the revision and negotiation of all contracts included within the parameters of the operation.

Advising an international investment fund on the acquisition and subsequent leasing (sale & leaseback operation) of a logistics platform.

Advising on the incorporation of real estate investment funds in Angola and o the relationship between the relevant management entities with the supervising entities. This included the legalization of the real estate assets in the portfolio.

Advising national tour operators on the incorporation and licensing of tourism developments, including drafting all regulating instruments and relationships between the owners and the development operator.

Advising a family owned business on the negotiation and closing of sale & leaseback operations for supermarkets, including prior due diligence of the assets.

Advising on the legalization before the land registry and tax authorities of retail units in Aveiro and Viseu, including carrying out a number of amendments to the titles of incorporation for horizontal property.

Advising on the drafting and negotiation of commercial agreements (joint-venture and association in participation) to develop construction, remodelling and sales of independent units and buildings.
