Ricardo Henriques authors guide on data protection in the employment context for OneTrust DataGuidance
Ricardo Henriques is the author of the Portugal chapter in the guide “Portugal – Employment”, published by OneTrust DataGuidance, which analyses the legal framework applicable to data protection in the employment context.
The guide systematises the main rules governing the processing of personal data in employment relationships, including the stages of recruitment, employee management and termination of employment, based on the General Data Protection Regulation (GDPR), Law no. 58/2019 and the Labour Code.
Among the topics addressed are the limitations on the collection and processing of sensitive data, the use of monitoring technologies, the framework applicable to remote working, as well as the challenges associated with the use of artificial intelligence and automated decision-making in the employment context.
