João Bravo da Costa and António Rafael author opinion article in Jornal Expansão

João Bravo da Costa, Partner at Abreu Advogados, and António Rafael, Of Counsel at Abreu Advogados, have authored an opinion article published in Jornal Expansão (Angola), focusing on the tax framework of the mining sector in Angola.

In the article, entitled “The deductibility of costs in mining contracts in Angola”, the authors examine the legal regime applicable to cost deductibility in the sector, with particular emphasis on the Angolan Mining Code and its interaction with the general Corporate Income Tax framework.

The analysis highlights the importance of this tax regime for the attractiveness of investment in the mining sector, underlining the need to balance operators’ returns with State tax revenues. It also identifies challenges associated with the sector’s evolution, including the need to update the legal framework in light of new economic and operational realities.

The authors further emphasise the impact of the qualification of deductible costs on the determination of taxable income, as well as the relevance of negotiating these elements at the stage of entering into mining investment agreements, which may significantly influence the viability and competitiveness of projects.

This contribution reinforces Abreu Advogados’ commitment to producing and sharing legal knowledge on key topics relevant to the markets in which it operates, particularly in the areas of taxation and investment in Angola.
