Ana Rodrigues de Almeida explains the new phase of the RJUE
Ana Rodrigues de Almeida explains, in an article published by Construir, that the proposal to amend the Legal Regime of Urbanisation and Building (RJUE), presented in December, is a deep and better-structured reform than the previous version. It strengthens the accountability of private parties, focuses on subsequent control rather than prior administrative control, and reduces or clarifies decision-making deadlines.
At the same time, it seeks to correct practical shortcomings of the current regime (such as minor works, urban development contributions and administrative offences) and to improve legal certainty, for example by limiting the possibility of annulment of acts, although it creates challenges for municipalities and developers.
This draft law “strengthens the accountability of private parties, the powers of inspection and subsequent control, and reduces the time limits for administrative decisions,” emphasises Ana Rodrigues de Almeida.
