Public consultation on the Decree-Law Transposing Partially the RED III Directive

The Office of the Minister of Environment and Energy has published the opening of a public consultation regarding the draft Decree-Law that partially transposes into national law Directive (EU) 2023/2413 of the European Parliament and Council, dated 18 October 2023 (RED III Directive).

This legislative proposal aims to:

  • Update national targets regarding the share of renewable energy in Portugal’s gross final energy consumption;
  • Set targets for increasing the share of renewable energy in the transport sector, imposing sustainability and greenhouse gas emission reduction criteria for the production and use of biofuels, bioliquids, and biomass fuels, as well as for renewable fuels of non-biological origin and recycled carbon fuels;
  • Impose targets applicable to the consumption of renewable energy in buildings, industry, heating, and cooling;
  • Establish mechanisms for issuing guarantees of origin.

Accordingly, it is proposed to repeal the following legal acts:

  • Law-Decree Nº. 84/2022, of December 9, in its current version, which sets targets for the consumption of energy from renewable sources, with the exception of Article 54, which regulates the commercialization of simple fuels;
  • Law-Decree Nº. 85/2025, of June 24, which defines renewable energy integration targets for the industrial and transport sectors;
  • Ordinance Nº. 110-A/2023, of April 24, in its current version, which regulates Decree-Law No. 84/2022, of December 9, referred to in item 1;
  • Ordinance Nº. 8/2012, of January 4, in its current version, which approves the operating rules of the Coordinating Entity for Compliance with Sustainability Criteria. However, since the functions of verifying compliance with sustainability and greenhouse gas emission reduction criteria will be carried out by the National Laboratory of Energy and Geology (LNEG, I.P.), this Ordinance will remain in force until its respective operating rules are approved.
