Ana Rita Duarte de Campos: “The limits of humour are those of freedom of expression”

In a context where the debate surrounding the limits of humour has gained increasing prominence, lawyer Ana Rita Duarte de Campos — partner at Abreu Advogados and specialist in Criminal Law — sees the limits of humour as those of freedom of expression.

Speaking to Jornal ECO, Ana Rita Duarte de Campos argues that humour, as a form of artistic expression, inherently involves a critical and hyperbolic dimension, and that “to disregard the characteristics of humorous discourse is to equate thought with criminal action — and that path is also very dangerous”.

The lawyer also highlights that “in the overwhelming majority of cases”, Portuguese courts do not issue convictions in the context of jokes, and she laments what she considers a regression in Brazil, referring to the recent case of comedian Leo Lins, who was sentenced to eight years and three months in prison.
