Approval of the NIS2 is “preliminary” and “conditions” the Government’s decree

Following the approval of the proposal for the transposition of the European NIS2 Directive – which aims to harmonise network and information security measures across the EU – Catarina Mascarenhas, consultant, and Catarina Rodrigues Rocha, trainee lawyer at Abreu Advogados, warn that the Government may still make changes to the draft decree-law.

The approval took place in September in the Assembly of the Republic but does not yet amount to full transposition. The lawyers told IT Channel that this step is “preliminary” and that it “conditions” the Government’s decree, explaining that the practical implementation of the cybersecurity legal framework “also depends on implementing acts by the European Commission and technical regulations from the National Cybersecurity Centre.”
