Ricardo Henriques underlines European data regulation is driving regulatory transformation
In statements to Jornal Económico, Ricardo Henriques emphasizes that the European framework on data has been the main driver of regulatory transformation over the past decade, highlighting the role of the GDPR (General Data Protection Regulation) and the impact of the Data Act, which establishes data-sharing rules.
The partner and co-coordinator of the Intellectual Property and Information Technologies Practice at Abreu Advogados notes that “in Portugal there has been no overregulation in data protection or cybersecurity,” although he recalls that “the transposition of NIS2 has not yet been completed” and that “the issue of managers’ liability may create asymmetries,” especially for companies with an international presence.
Henriques considers legislative fragmentation to be “the third major obstacle to the expansion of European innovative technology companies,” pointing out that the diversity of national rules within the EU continues to hinder harmonization and competitiveness.
