“Our Constitution – no constitution – will ever be perfect. So why revise it again now? And in what respects?” These are the questions raised by Luís Fábrica, of counsel at Abreu Advogados, in an opinion piece published in Human Resources Portugal.
In light of the recent discussion surrounding a possible constitutional revision, Luís Fábrica notes that “it is true that some of the proposed amendments are necessary or, at the very least, enjoy broad consensus.” However, “other proposed changes are divisive – to put it mildly – and will certainly not achieve the required two-thirds majority.”
“One of the congenital flaws of our Constitution (and of others) is its tendency to stretch into well-intentioned proclamations with little or no normative substance. What is the point of overloading it now with a new batch of virtuous statements, destined for complete practical irrelevance?”
