Ricardo Henriques discusses the impact of the EU AI Regulation and the challenges of Intellectual Property
Ricardo Henriques, partner and co-head of the Intellectual Property and Information Technology practice at Abreu Advogados, was interviewed by Advocatus for an in-depth reflection on the role of Intellectual Property in the current technological and legal landscape.
In the interview, Ricardo Henriques highlights the strategic importance of Intellectual Property (IP) as a tool for enhancing innovation and protecting intangible assets, particularly in a context marked by the emergence of new technologies and the rapid development of Artificial Intelligence (AI).
The interview touches on several key topics, from the limits of copyright and patent protection for AI-generated creations, to the challenges posed by emerging legal disputes — such as Getty Images v. Stability AI and Concord Music Group v. Anthropic PBC —, as well as the debate surrounding civil liability for automated decision-making.
Ricardo Henriques also explains how traditional IP rights, such as trademarks, patents and copyright, remain applicable, although they face new challenges in adapting to digital dynamics. He further comments on the role of the European Union in this area, particularly in relation to the new AI Regulation and the (now withdrawn) proposal for a specific civil liability framework for AI.
