Commission Decision (EU) 2020/2152 sets the fees for collecting, handling, processing and analysing information reported by market participants or entities reporting on their behalf, pursuant to Article 8 of Regulation (EU) No 1227/2011, and how they should be paid to the European Union Agency for the Cooperation of Energy Regulators (ACER).
Open and fair competition in the internal electricity and gas markets and ensuring a level playing field for market participants require integrity and transparency in wholesale energy markets.
Since 2021, and following the adoption of Regulation (EU) 2019/942, (ACER) has been partially financed by fees.
Pursuant to Article 31 of Regulation (EU) 2019/942, the Agency should be financed mainly from the general budget of the Union.
The regulation provides for fees to be charged to finance the work carried out by the Agency on wholesale energy market integrity and transparency (REMIT).
Following the review of REMIT in 2024, this initiative will update Commission Decision (EU) 2020/2152 on the setting of such fees.
The future Decision is expected in the fourth quarter of this year.
