Ricardo Henriques comments on the new legal framework for cybersecurity in Jornal de Negócios

A new Legal Framework for Cybersecurity has been introduced, transposing a European directive known as NIS2. This framework directly holds administrators and managers accountable for cybersecurity breaches and increases the fines applicable.

Ricardo Henriques, partner at Abreu Advogados and co-coordinator of the Personal Data Protection and Cybersecurity service, stated in a comment to Jornal de Negócios that the aim of this change is “to create greater incentives for law enforcement, placing the burden on administrators.”

The lawyer added that, essentially, it will be up to administrators “to oversee and ensure that the entity complies with its obligations and rules,” noting that “it won’t be a minor or detailed failure that will hold them accountable.”
