Portugal: acordos de cash pooling e isenção do imposto de selo

Mariana Gouveia de Oliveira, Sócia Contratada da Abreu Advogados, Nuno da Cunha Barnabé, Sócio, e Susana A. Duarte, Advogada Associada Sénior, assinaram um artigo na IBA – International Bar Association sobre os acordos de “cash pooling” e isenção do imposto de selo em Portugal.

No artigo, os advogados referem: “Portugal is still far from settling this matter. For example, the law has not yet been amended (nor is any proposal to amend the law under discussion). Secondly, the tax authorities continue to maintain that there is no breach of EU law. Lastly, and more importantly, there is no consensus on this topic amongst the tax courts (including the tax arbitration courts)”.
