Sofia Silva e Sousa comments on the rule that foresees the duty of employers to refrain from contacting workers

Sofia Silva e Sousa, Associated Partner at Abreu Advogados, comments, in statements to the newspaper Público, the rule approved in Parliament which provides that the employer has the duty to refrain from contacting the worker during his rest time.

The lawyer argues that “the new wording gives greater protection to workers who choose not to respond to the employer’s contact during their rest period, insofar as it establishes that any less favourable treatment given to a worker, namely as regards working conditions and career progression, because he exercises the right not to be contacted, will constitute discriminatory action”.
